These Terms of Use (hereinafter, these “Terms”) between Joana Manuel Dos Santos Jorge (hereinafter, “Joana Santos”, 'the photographer", "the service provider" “us” or “we”) operating in Portugal and you (hereinafter, “the user”, "the customer", 'the client"), collectively referred to as the "Parties", together with Wix Terms of Use (collectively: the “Terms”) set forth the terms and conditions which govern your use of the Website www.joana-santos-commercial-photographer.com

The user acknowledges having read this legal notice and agrees to respect it.

The user of the website acknowledges having the skills and means necessary to access and use this site.

The user acknowledges having been informed that the website www.joana-santos-commercial-photographer.com is accessible 24 hours / 24 hours and 7days / 7 days, except in case of force majeure, computer difficulties, difficulties related to the structure of telecommunications networks or technical difficulties.

For maintenance reasons, the service provider may interrupt access to his site and will endeavor to inform users in advance.

Terms and Conditions

These terms and conditions create a legal agreement and apply to all orders and all sales of services and products concluded between the Client(s) and Joana Santos. They are fully and unreservedly accepted by the Client(s) by contacting us by the website www.joana-santos-commercial-photographer.com the Client(s) declares that he has read these general conditions.

We offers services as presented on the website www.joana-santos-commercial-photographer.com

 

These Terms and Conditions contains the entire understanding between Joana Santos and the Client(s). It supersedes all prior and simultaneous agreements between the Parties.

Any document other than these Terms and Conditions and in particular catalog, prospectus, advertisements, notices, has only an informative and indicative value, not contractual. These general conditions of sale form an indivisible contractual document with the service contract signed by the Client(s).

The only way to add or change this agreement is to do so in writing, signed by all the Parties. If the Parties want to waive one provision of this agreement, that does not mean that any other provision is also waived. The party against whom a waiver is sought to be effective must have signed a waiver in writing.

Official Communication Channels:

 

Client(s)  are encouraged to exclusively use our official communication channels:

  1. emails with the domain @joana-santos-commercial-photographer.com

  2. phone calls scheduled via our website

  3. contact form in the website footer.

 

Orders through unofficial channels will be declined for security reasons. We're not responsible for any fraudulent activity or fake profiles; Client(s)  must ensure communication authenticity.

Pricing:

All prices are expressed in Euro (€) and are displayed without VAT. The prices displayed on our website are subject to change without prior notice. However, any previously agreed-upon services will be invoiced at the agreed-upon price.

Pricing Confidentiality:

 

All pricing, discounts, and related communications between the Client(s)  and us are confidential. Client(s) agree to keep this information private, sharing it only as necessary to fulfill obligations under this Agreement. All parties agree to maintain confidentiality, refraining from using this information for any business purposes, whether competitive or not.


Payment Methods:

 

We accept the following payment methods:

  1. Direct Bank Transfer: Our bank details will be sent to you via email.

  2. Cash Payments: Please note that cash payments may be subject to legal limits. While we accept cash, we strongly encourage traceable transactions for security purposes.

  3. Credit/debit cards via Wix Payments App ;

Payment Deadline:

For online bookings, payment is expected at the time of reservation. For price quotes accepted, payment is due by the next business day. Bank transfers should be received within 5 business days from the due date

Overdue Payment:

 

Delays, except for Force Majeure, may incur a 5% daily interest charge until full payment. The photographer reserves the right to withhold final products until the balance is settled.

Price Quote Policy:​ 
 

Client(s)  must request a price quote for custom orders through our official channels. We provide quotes via Ascend by Wix price quotes, sent from our email hello@joana-santos-commercial-photographer.com, valid for 30 days. Acceptance of the quote electronically or via email confirmation constitutes a contractual agreement. Payment processing occurs upon acceptance; work will not commence until both acceptance and payment are received by us.

Proforma Invoice:

Accepted price quotes are automatically converted to Proforma Invoices. VAT cannot be recovered based on the Proforma Invoice; the tax invoice will be issued upon payment receipt. Client(s)  are responsible for all costs related to foreign currency payments, including exchange rate fees and bank charges.

Service Booking Process:

 

To book a service, schedule a phone call, or get a price quote, visit www.joana-santos-commercial-photographer.com or email hello@joana-santos-commercial-photographer.com or booking@joana-santos-commercial-photographer.com. Client(s)  must accept terms and conditions to confirm orders.

Pre-Booking: 

  • For online bookings paid via bank transfer or cash, your pre-booking will be held for 5 business days. If payment is not received within this time, your pre-booking may be canceled, and the date may become available to others.

  • For custom inquiries and price quotations: no date is secured until payment is received.

Please ensure payment is received before your scheduled session, as the service provider will not attend otherwise.


Booking Confirmation:

 

Upon receipt of payment, you will receive a booking confirmation email confirming your scheduled session. Your booking is considered confirmed upon receipt of this confirmation email.

Booking via online booking system:
 

By making a booking via our online booking system on our website, Client(s) acknowledge reading and understanding the service description and terms. Additional services or costs must be purchased separately.

Our online booking service is provided by Wix Bookings; we're not responsible for any technical issues related to this application. Our booking system is synced with our schedule to prevent double booking. In case of any scheduling issues, we'll contact you to resolve any scheduling issues within 2 business days.

 

If the service location differs from the service provider's location, please contact us before booking to confirm pricing and availability; note that travel time may not be included, requiring additional arrangements.
 

Travel Fees, Costs, and Expenses:

 

The Client(s) is responsible for all expenses, costs, and fees related to the service, including but not limited to travel time, transportation, accommodation, meals, parking, shipping, rentals, and other incidental expenses. Travel distance is calculated from the service provider's location using Google Maps and rounded up to the next multiple of 10 kilometers.


Refund Policy:

 

Payments for our services are non-refundable in the event of Client cancellation or postponement, aimed at compensating the service provider for any loss of opportunity.

Digital products, which may include licenses, photos, videos, or other digital content, are also non-refundable.

In cases of force majeure, a rescheduled date will be offered. Booking fees already paid for this specific booking will be credited towards a future session, but any incurred costs and expenses will be due.

If the Client(s) choose to cancel an outdoor session due to weather conditions not meeting their preferences (e.g., full sun, partial shade, cloudy sky, fog), while the conditions are safe for the session, it will be considered a cancellation by the Client(s).

In the event of rain, strong wind, snow, or any weather that could damage the service provider's equipment, the outdoor session will be rescheduled. Booking fees already paid for this specific booking will be credited towards a future session, but any incurred costs and expenses will be due.

In the event that our service becomes unavailable due to illness or injury on our part, we will offer options for rescheduling or provide a replacement service provider if possible. If no solution can be found, a refund will be issued.

Refunds, if applicable, will be processed within 15 business days via bank transfer upon receiving your accurate bank account details. We're not responsible for delays due to incomplete or inaccurate bank information provided by the Client(s) or processing times of financial institutions.

For print orders, refunds are governed by Pic-Time's​ terms and conditions, with processing times subject to their policies. While we'll ensure timely processing, we're not liable for any delays due to Pic-Time's procedures.
 

Force Majeure:

 

Neither party shall be liable for any failure to perform their obligations under this agreement if such failure is due to circumstances beyond their reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, strikes, riots, government actions, or any other unforeseen event ("Force Majeure Event"). In the event of a Force Majeure Event, the affected party shall promptly notify the other party and make reasonable efforts to mitigate the impact of the event.

 

The obligations of the parties shall be suspended for the duration of the Force Majeure Event, and any timeframes or deadlines shall be extended accordingly.

Additional costs for the rescheduled shoot will be the Client(s) responsibility.

If a force majeure event prevents the session as scheduled, it will be postponed to a later date agreed upon by both parties. Booking fees already paid for this specific booking will be credited towards a future session, but any incurred costs and expenses will be due.



Right of withdrawal:

 

The Right of withdrawal does not apply to photos, prints and services delivered by the Photographer, insofar as they constitute not only "clearly personalized" goods but also sometimes "digital content provided on an intangible medium", 2 exceptions legal to the right of withdrawal. 

Change Policy:

Immediate notification to us is required for any schedule or location changes, with confirmation of receipt from the service provider. Availability of specific dates or locations cannot be guaranteed. Any requested changes may incur additional fees and expenses.

Any change in date or time constitutes a postponement, subject to the refund policy. Changes in location may incur additional travel costs, with the Client(s) responsible for covering such expenses.


We strive to accommodate any reasonable requests, but we cannot guarantee their availability or feasibility.

 

Communication Policy:

All communication must be conducted through our official communication channels. Client(s) are responsible for ensuring the accuracy and currency of their contact information. We cannot be held responsible for miscommunication resulting from incorrect or outdated contact details.

 

Client(s) are encouraged to schedule phone appointments via our website to ensure efficiency. Appointment requests will be manually approved, and alternative dates and times will be suggested if necessary to maintain service quality.

We endeavor to respond to all communication within 2 business days. Client(s) are requested to confirm all events and times one week prior to the scheduled session. While we strive to accommodate last-minute requests, we cannot guarantee their fulfillment.
 

Client(s)  can schedule a phone call via online booking on our website. However, as a freelance photographer committed to uninterrupted work, phone calls are muted by default except for authorized calls. On the day of the photoshoot, communication with the Photographer is available, by default, through WhatsApp at +351 934 419 874.

In cases of no internet or signal, communication cannot be guaranteed, and service providers cannot be held responsible for missed or delayed communication.

If no response is received from the Client(s) after an initial email and a follow-up email within a two-week period, it will be considered as Client cancellation.

Photo Selection:

Client(s) will receive a link to access a private password protected online photo gallery via email to choose their preferred photographs for editing. Once selections are finalized, no further modifications can be made.

For additional edited photographs beyond the agreed number, Client(s) should contact the photographer via email for a price quote. Acceptance and payment must precede any further editing.

If the Client(s) has not made their selection within two weeks, the photographer will curate a selection based on the agreed-upon number of edited images.

Delivery:

Digital images will be delivered to Client(s) within one month after the photoshoot via an online photo gallery sent through email. This gallery will be hosted on a password-protected platform and include a custom print store.


Images will be available for download in Web-Ready JPG format, by default at 2048px resolution; other formats require extended usage rights.

 

Client(s) have one month from the delivery date to download the photographs from the gallery, which includes a free one-month use period. After this period, the gallery will be offline unless Client(s) purchase photo backup.

 

Physical print products are fulfilled and delivered by Pic-Time's photo laboratory partners. The photographer is not liable for any delivery issues, delays, damage, or loss during parcel delivery. In case of delivery issues, an investigation will be conducted with the carrier.

 

Revisions:

Revisions are not included in our services. Additional charges will apply for requested changes based on Client(s)  feedback, determined by the extent of the work required. The photographer reserves the right to reject any non-credible requests not aligned with quality standards or artistic style.

Photo Backup:

 

Joana Santos, the Photographer, shoot with dual SD card slots to ensure a backup during the photoshoot. Additionally, we create a backup during the post-production process. A photo backup is provided for one month after the delivery of photographs via the online photo gallery.

 

Please note that beyond this 1-month period, the photographer does not guarantee the availability of any backups. After this period, it is the Client(s) responsibility to manage and secure their files. The photographer is not responsible for any loss or damage to the digital files given to the Client(s) .

We offer the option to purchase a photo backup through the photo gallery store. This service maintains the online gallery with an integrated cloud backup, making the photos accessible on all devices.

Retrieving archived files after the initial one-month period may incur additional fees, as this usually involves extra effort and resources to locate and retrieve the stored files..

Authorization Forms, Photo & Video Releases, and Permits:

 

To comply with laws and regulations, the service provider requires specific authorization and consent forms, including but not limited to photo & video release or consent forms, to be signed before the scheduled session.

 

For transparency, our standard photo & video release and consent forms are available on our website’s contact page. They can be signed electronically on most devices, including computers, tablets, and mobile phones.

 

Client(s) requesting a photoshoot that requires photo & video release authorizations for themselves, or any other individuals who will be photographed during the session, must review these forms before placing their service request. Refusal to sign these forms will result in the photoshoot being considered a Client cancellation.

For real estate photography or any service requiring, for example, a rented location, it is the Client(s) responsibility to obtain all necessary permits and cover any associated costs. Failure to obtain the required permits or pay necessary fees may prevent the Photographer from providing the requested service, for which the Photographer cannot be held responsible.

Indemnification:

 

The Client(s) agree to indemnify and hold harmless Joana Santos, its affiliates, employees, agents, collaborators, contractors, and licensors from and against any and all claims, demands, causes of action, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or in any way related to:

  1. The Client(s)' breach of any provision of these Terms and Conditions.

  2. The Client(s)' violation of any law or the rights of a third party.

  3. The Client(s)' use of the photographs or services provided by Joana Santos

  4. Any content submitted or transmitted by the Client(s) through our website or services.

  5. Any unauthorized use of any content obtained from our website or services.

  6. Any negligence or willful misconduct by the Client(s).

Additionally, the Client(s) shall indemnify and defend the Photographer against all claims, liabilities, damages, costs, and expenses, including reasonable legal fees and expenses, arising from the creation or any use of the Photos or materials provided by the Client(s). It is the Client(s)' responsibility to obtain the necessary model consent, property releases or permits and ensure they are fully effective and in force.

This indemnification obligation will survive the termination of these Terms and Conditions and the Client(s)' use of our website or services.

Photographer's Creative Control:

The Photographer maintains full creative authority over the pre-selection and editing of photographs. The delivered digitals may not encompass all shots taken during the session. Only images meeting the Photographer's professional quality standard and artistic vision will be released.

The method and style of photography are solely at the discretion of the Photographer. Client(s) do not have authority over the Photographer's approach. While efforts will be made to align with Client(s) specifications, final creative decisions rest with the Photographer.

Intellectual Property:

 

The Photographer retains full ownership and copyright of all photographs created during the shoot. By default, the Client(s) grants permission for the Photographer to use the photographs for marketing purposes. If the Client prefers exclusivity, they may purchase an exclusive photo license at an additional cost. Any modification, reproduction, or use of the photographs beyond the agreed license requires written permission from the Photographer. Unauthorized usage constitutes a breach of copyright and may result in legal action.

Photographer Credit:

 

It is a legal requirement to acknowledge the authorship of the photographs. The Client(s) must credit the photographer by including their name or copyright symbol (Ⓒ) along with the year of the photo, on all digital or print publications  (e.g. Photo by Joana Santos, Commercial Photographer). For social media posts, tagging the Photographer's account is required. Failure to credit may result in legal action.

Copyright:

 

All photographs created by the Photographer are protected under copyright laws, and the Photographer retains the copyright to all images.

 

The Client(s) agree not to use the photographs for any purposes without purchasing a photo license from the Photographer. Copyright notices must not be removed or altered, and unauthorized use may result in legal action.

 

The Client's purchase of files releases the Photographer from liability for loss or damage and from any obligation to maintain copies. By default, the Client(s) grant the Photographer the right to license the photos to other parties.

Usage Right:

The licenses sold on our website online store are Limited Rights, Rights-managed, Non-Exclusive, Non-Transferable, Non-Sub-Licensable Limited. They have specific usage durations. For extended or exclusive rights, please request a price quote. Clients can request a preview of the desired license before purchase.

Clients may not alter or edit the images without the photographer's written consent, except for adding company names, logos, cropping, or text related to the company for advertisement purposes.

 

Unauthorized use of the photographs may result in legal action.



Editing and Retouching:

Joana Santos will use their professional judgment and expertise to edit and retouch the photographs, including adjustments such as color correction, contrast, brightness, cropping, and other technical enhancements. Retouching may also involve more detailed edits like object removal, skin retouching, and dust cleaning. Any additional editing requested by the client beyond the initial editing will incur an extra fee.

 

Both parties agree to use only the photographs processed by the photographer or by an external photo editor chosen by Joana Santos, based on their requirements.

 

Please note that the photographer reserve the right to refuse requests that involve altering someone's physical appearance by distorting their face or creating unrealistic results that may be problematic for the use of the photographs.

Service Performance:

 

Both parties agree to maintain cheerful cooperation and open communication to achieve the best possible results. While the service provider commits to delivering high-quality images or videos as outlined in the order, it's important to note that the service provider is not obligated to guarantee specific outcomes. The artistic content is at the discretion of the Service Provider.
 

Limitation of Liability:

 

In the event that our service becomes unavailable due to illness or injury on our part, we will offer options for rescheduling or provide a replacement service provider if possible. If no solution can be found, a refund will be issued.

While we take precautions to prevent loss or damage to your images and videos, unforeseen circumstances may arise where images could be lost, stolen, or destroyed. The service provider will promptly address the situation and propose a suitable resolution. This may include a partial refund of creative fees or a proportional refund based on the quantity of images/videos delivered.

Furthermore, the service provider is not liable for missed photographs or videos resulting from weather conditions, scheduling issues, location restrictions, or interruptions by third parties. We do not guarantee a specific number of final photographs or the behavior of subjects. Any submitted shot lists are used as reference but may not fully reflect the final output.

Aerial Photo and Video Services:  

The drone pilot is a separate business in collaboration with the Photographer. By booking drone services through our online booking system, you acknowledge and agree that the drone pilot and their company are solely responsible for the safe operation of the drone.​

 

By using aerial photography and videography services, you release Joana Santos from any liability related to these services, including accidents, damages, or injuries caused by the drone or the drone pilot.

Outdoor Photography:

The Photographer advises the Client(s) on the best time to start the photoshoot for optimal lighting conditions, taking into account factors like date, sunlight duration, and sun position.

 

However, as weather forecasts may be unreliable and natural conditions are beyond control, the Photographer cannot be held responsible for variations in brightness, wind, cloud cover, rain, fog, or other weather patterns.

 

If the Client(s) choose to cancel the photoshoot due to weather conditions not meeting their preferences (e.g., full sun, partial shade, cloudy sky, fog), while the conditions are safe for the session, it will be considered a cancellation by the Client(s).

In the event of rain, strong wind, snow, or any weather that could damage the photographer's equipment, the session will be rescheduled. Booking fees already paid will be credited towards a future session, but any incurred costs and expenses will be due.

Safety Policy:

To ensure the safety of all individuals present during the session, the Client(s) and any other individuals related to the Client(s) must comply with the safety guidelines established by Joana Santos. This includes refraining from touching any professional equipment, such as lights, camera, cables, tripods, props, and bags, and following the instructions of Joana Santos and her assistant(s) at all times.

This is not only to ensure that the equipment is not damaged, but also for safety reasons. Children and pets must be supervised by their parents or guardians and kept away from any potentially hazardous equipment.

Failure to comply with these safety guidelines may result in the termination of the session, and the responsible party will be held accountable for any damages or injuries caused.

Security Policy:

To ensure the safety of all individuals present on set, the photographer has implemented a strict security policy. By adhering to this policy, we can ensure a safe and successful session.

The following guidelines will be strictly enforced:

  1. The photographer reserves the right to decline working in any location that she considers dangerous (such as on the edge of a cliff, at an unsafe distance from motorized or non-motorized sports vehicles, in a ruin, etc.), in conditions that could endanger her safety, or in any other situation where the safety of the client, team, guests, equipment, or anyone present on set would be compromised.

  2. The photographer reserves the right to refuse to work if the conditions of herself and/or her client, photographer equipment, team, guests and anybody present on set would put them in danger and fail to comply with safety regulations (such as in the trunk of a vehicle, on a ladder, etc.).

  3. The photographer also reserves the right to refuse inadequate accommodation or any location that she deems to have insufficient security measures for her personal safety and equipment, and for her client, team, guests and present on set.

  4. The photographer reserves the right to charge for any expenses incurred in booking a safer hotel room if necessary including travel fees and costs.

  5. All participants must comply with safety regulations and instructions provided by the photographer and team.

  6. All personal belongings and equipment brought onto the set are the sole responsibility of their owners, and the photographer will not be held liable for any loss or damage.

  7. In case of an emergency, participants must follow the photographer's instructions and evacuate safely.

 

By agreeing to this security policy, all participants agree to comply with these regulations and guidelines. Failure to do so may result in the termination of the project without refund or compensation.

No-Substance Policy:

 

The photographer is committed to ensuring a safe and professional environment for everyone involved in the project. We prioritize the health and well-being of our team, clients, and anyone present on set.

The use of alcohol, and drugs is strictly prohibited on set. Smoking is not allowed on set, and any person found to be under the influence of any substance will be immediately excluded from the set and will not be permitted to return. No alcohol or drugs may be brought to the set or consumed on the premises. Anyone caught providing alcohol or drugs to others without their consent will be subject to legal action.

 

We expect everyone to adhere to this policy, and any violations will not be tolerated. Any person who violates this policy may be removed from the set, and the person may be charged for any costs or damages caused by the violation.
 

Photographer Authority Policy:

During the photo shoot, the Photographer has sole authority over directing and capturing client photographs. No amateur photographer, videographer, or individual may interfere with the Photographer's work. This includes taking photos, adjusting equipment, giving directions to clients, or posing clients. Interference may compromise the final product's quality.

Additionally, the Photographer's assistants and support staff play crucial roles in maintaining set operation. Any interference with their work, such as requesting unrelated tasks or engaging in conversation, may affect the final product's quality. Therefore, Client(s) and all present are requested to refrain from interfering with assistants and support staff.

Client(s) are asked to inform guests of this policy beforehand. Any interference will result in immediate removal from the set to ensure session continuity and everyone's productivity.

Furthermore, Client(s) and individuals present must refrain from taking backstage photographs without prior Photographer and party consent. Authorized photographs should not disrupt the ongoing shoot or individuals present.

 

Set Access Policy:

Access to the set during a session is restricted to authorized individuals only. Prior consent and authorization from the photographer and/or Client(s) are required for access.

Access to the set is solely at the discretion of the photographer and/or client and may be revoked at any time for any reason. Unauthorized access may result in removal from the set and legal action.

Authorized individuals must conduct themselves professionally and adhere to safety and security policies. Violations may lead to removal from the set and legal action.

Access may be restricted to certain individuals (e.g., models, crew, guests) for safety, creative reasons or any factors deemed necessary by the photographer.


Any individual granted access to the set must also sign any required releases or agreements, including but not limited to model releases, location releases, and non-disclosure agreements. 
 

The photographer will take all reasonable steps to ensure that the set is a safe and secure environment for all authorized individuals, and will not be liable for any injury, loss, or damage suffered by individuals on the set due to their own negligence or failure to comply with safety policies and procedures.

Behavior Standards & Anti-Harassment Policy:

Everyone is expected to behave professionally and treat others with dignity and respect.

 

The photographer will not tolerate any inappropriate behavior throughout the project, as it affects:

  • The physical and mental well-being of individual(s)

  • Productivity and costs

  • Individuals' reputations

The following behaviors are strictly prohibited:

  • Harassment, bullying, verbal abuse, physical aggression, and violence

  • Offensive jokes

  • Pressure for dates or sexual favors

  • Inappropriate sexual touching, gestures, comments, or invasion of personal space

  • Unwelcome comments about religion, race, gender or sexual orientation

  • Discrimination of any kind

Nudity will not be accepted, except if there is a signed contract between the model and the photographer where the limits are explicitly defined. No act of voyeurism or invasion of privacy will be tolerated.
 

In the event that the photographer is targeted by one of these inappropriate behaviors, the photographer reserves the right not to continue the work that has been requested of her and leave the set. In the event that someone other than the photographer is the target of any of these inappropriate behaviors, the photographer reserves the right not to proceed with the work that has been requested of him until the person who has inappropriate behavior is not excluded from the project.
 

Any violation of human rights will be reported to authorities and pursued legally.

LGBTQ+ Policy:

We strive to create an inclusive environment for all, regardless of sexual orientation or gender identity. We treat all clients, models, and staff with respect and dignity, without discrimination.

Model Selection:

While we may consider specific physical features to meet client preferences, such as eye colour or hair type, we welcome all individuals to apply as models on our website. We celebrate diversity and value each person's uniqueness. Please note that while we aim to accommodate Client(s) requests, we are not accountable for their specific choices regarding model selection. Our ultimate goal is to create beautiful and impactful content while promoting respect and inclusivity.
 

Model's Privacy and Well-Being:

The Photographer prioritizes the model's privacy, well-being, and comfort to capture the best photographs. This may involve limiting guests or working with a smaller team, or solely with the Photographer. Respecting models as individuals is paramount, as their comfort directly affects their work. Any disruption to the model will result in removal from the set.

In order to ensure the comfort and well-being of all models, it should be noted that some models may not wish to have male individuals present during their photo session due to inconfort or past traumas. However, during the time that a model is present on set, it is essential to obtain her consent, respect her privacy and provide a safe and reassuring environment for her.

Waiver:

No action taken by either party, except through express written waiver, shall be construed as waiving any provision of this terms. A single or partial exercise of any rights or remedies by either party will not prevent further exercise of other rights or remedies.

Severability:

 

If any provision of the terms and conditions is found to be invalid, illegal, or unenforceable, the validity, legality, and enforceability of the remaining provisions shall not be affected. Such provisions shall be revised only to the extent necessary to make them enforceable.

Applicable Law:

 

The contractual relations between the parties governed by these general conditions are exclusively subject to Portuguese law. Any dispute relating to the formation, execution, or interpretation of these general conditions, as well as any agreements to which they apply, will, in the absence of an amicable agreement, be subject to the exclusive jurisdiction of Portuguese courts. Any legal action must be taken to a court located in the department of residence of the photographer.​
